1. INTRODUCTION

1.1. These Terms and Conditions govern access to and use of the website www.atelierfusion.pt, as well as the terms applicable to the purchase of products sold under the Fusion brand.

1.2. The website www.atelierfusion.pt is operated by the company Graça Castro, Unipessoal, Lda., VAT number 516964720, with registered office at Travessa Monte de Cima, lote 6, Gondar, Guimarães (Portugal).

1.3. For the purposes of interpreting these Terms and Conditions, the following definitions shall apply:

      a) "FUSION" – Refers to the products sold through the website www.atelierfusion.pt;

      b) "User" – Any natural person, of legal age and not acting as a trader, who places an order through the website www.atelierfusion.pt;

1.4. Access to the website www.atelierfusion.pt, as well as the purchase of Fusion products, implies prior knowledge, full understanding, and unreserved acceptance of these Terms and Conditions by the User.

2. WEBSITE REGISTRATION

2.1. To place an order, the User may first register by filling out the form available on the website www.atelierfusion.pt.

2.2. From the moment the User accesses their personal account, they are subject to these Terms and Conditions.

3. FUSION PRODUCTS

3.1. The website www.atelierfusion.pt is intended for all users who wish to purchase Fusion products online, 24 hours a day, 7 days a week.

3.2. Information about product features is available on the respective product pages.

3.3. Fusion reserves the right to modify, at any time, the information, product offerings, prices, promotions, and commercial conditions presented on the website www.atelierfusion.pt.

4. PLACING ORDERS ON THE WEBSITE

4.1. To place an order on the website www.atelierfusion.pt, the User must have an email account and ensure that their browser is configured to accept cookies and pop-ups, which are necessary to fully experience the functio-nality of the Fusion online store.

4.1.1. The User may proceed with the online purchase of products by following these steps:

      a) Find the product(s) they wish to purchase;

      b) Add the selected product(s) to the "Shopping Cart";

      c) Enter their personal details, which will be stored in Fusion’s database in accordance with the Privacy Policy, including "Delivery Address", "Billing Address", "Payment Method", phone number, and tax identification num-ber (VAT/NIF);

      d) Review the order and confirm the purchase request.

4.2. The User will receive an order confirmation email with the details regarding the selected payment method.

4.3. The order will be delivered by the logistics operator to the delivery address indicated during the purchase process, along with the corresponding detailed invoice.

4.4. By submitting the order form, the User agrees to the Terms and Conditions of purchase described on www.atelierfusion.pt, as well as the Privacy Policy.

4.5. Fusion reserves the right not to accept and to cancel confirmed orders in the following situations:

    a) The product is unavailable;

    b) Payment is not made using any of the available payment options on the website www.atelierfusion.pt;

    c) Payment cannot be confirmed;

    d) The billing information is incorrect or unverifiable;

    e) There is a pricing error;

    f) Delivery to the address provided by the User is not possible.

5. PRICES

5.1. All product prices displayed on the website www.atelierfusion.pt are expressed in euros (€) and include Value Added Tax (VAT) at the applicable legal rate, unless otherwise stated.

5.2. All prices are quoted in euros (€). Please note that changing the delivery country may affect prices due to different shipping costs. Customs duties related to the delivery country will be borne by the customer.

5.3. Fusion reserves the right to change prices at any time without prior notice. However, such changes will not affect orders that have already been confirmed.

5.4. If an error is found in the price of the requested products, either Fusion or the User may cancel the order prior to its shipment.

5.5. The total price specified at checkout includes taxes from the country of origin (Portugal) and shipping costs.

5.6. The User must pay only the amount specified in the order confirmation.

6. PAYMENT METHODS

6.1. Payment for orders can be made using the methods available on the website at the time of purchase, namely:

      a) Credit or debit card (Visa, Mastercard, among others);

      b) Multibanco reference (valid only within Portuguese territory);

      c) MB WAY;

      d) Other payment methods that may be made available by Fusion.

6.2. Fusion does not accept any payment method other than those mentioned above. The User should not attempt to make a payment using any method not specified in the listed payment options. If they do so, we cannot be held responsible for loss of payment or any other damages that may result.

7. SHIPPING COSTS

7.1. Shipping to Portugal has a cost of €5.

7.2. For deliveries outside Europe, all orders will incur shipping costs and may be subject to customs duties depending on the destination country, which are the responsibility of the customer.

8. DELIVERY

8.1. Fusion ships the product(s) ordered by the User from Monday to Friday, between 9:00 AM and 3:00 PM, excluding public holidays, and in accordance with the schedules used by the logistics company, to the delivery address provided by the User.

8.2. Our delivery service does not include a scheduling option, so the order will be delivered without prior contact from the courier. It is the User’s responsibility to ensure someone is available at the delivery address.

8.3. Delivery times in Portugal range between 15 to 20 business days, depending on the item ordered. Fusion's ability to meet these deadlines depends on stock availability and may be affected during promotional periods, sales, or Christmas.

8.4. Fusion will inform the User if the ordered product(s) are unavailable and will refund the amount paid within a maximum period of fifteen (15) days from the date the unavailability is confirmed.

8.5. If the carrier is unable to deliver the products on the scheduled date, the User will be contacted to arrange a new delivery date.

8.6. At the time of delivery, the User should inspect the package for any possible damage. If the products are found to be damaged, the User should refuse the delivery, and the order will be returned. The User must report the issue, preferably with photographic evidence, to geral@atelierfusion.pt. If the User agrees, Fusion will resend the order at no additional cost. If the User prefers to cancel the order, a full refund will be issued.

8.7. If you do not receive your order within ninety (90) days from the date of payment, please contact us via email at geral@atelierfusion.pt to report the issue. After this period, Fusion cannot be held responsible for lost orders.

8.8. Delivery is considered complete upon signature of the delivery receipt at the agreed address.

9. RIGHT OF WITHDRAWAL

9.1. The User has the right to freely withdraw from the contract concluded with Fusion within 14 (fourteen) days after receiving the order, provided that:

      a) The product(s) have not been used;

      b) The product(s) retain their original characteristics and intact tags;

      c) The product(s) are complete. All materials accompanying the order must be returned.

9.2. The User may exercise the right of withdrawal by sending an email to geral@atelierfusion.pt.

9.3. Return shipping costs in the exercise of the right of withdrawal are the responsibility of the customer.

9.4. Once the returned product is received, Fusion will inspect and confirm its condition and, when applicable, will refund the amounts paid by the User within a maximum of fifteen (15) days, using the same method of payment used for the original purchase.

9.5. If the returned items show signs of use, Fusion reserves the right not to accept the return and to refuse the refund.

9.6. The User should note that if the return is made for reasons other than a justified defect or non-conformity of the ordered products, Fusion will not refund any shipping costs. Therefore, Fusion will not reimburse the initial shipping expenses originally paid by the customer.

9.7. Please note that these conditions are only valid for orders placed within Portugal. If your order was placed from outside Portugal, please contact us at geral@atelierfusion.pt.

9.8. Initial shipping fees and customs duties are non-refundable in returns for reasons not attributable to Fusion.

9.9. International Returns and Customs

For returns from countries outside the European Union, the customer must declare the shipment as “Return of Goods” with zero customs value (“no commercial value”). If this is not done and customs duties are charged, Fusion will not cover those costs.

10. CANCELLATIONS AND RETURNS

10.1. The User may cancel their order by requesting it via email to geral@atelierfusion.pt, provided the request is made before the order has been shipped.

10.2. If the cancellation request is received before shipping, we will refund the amounts paid by the User using the same payment method used for the original purchase, within a maximum of fifteen (15) days.

10.3. If the cancellation request is received after the order has been shipped, the rules outlined in the previous chapter (Right of Withdrawal) will apply.

10.4. In the case of an exchange, the User must bear all shipping costs associated with the new shipment.

10.5. If the ordered product is defective or otherwise non-compliant, the User may choose to:

      a) Replace the product;

      b) Cancel the contract.

10.6. As soon as the User detects a defect or other non-conformity in the product, they must notify us via email at geral@atelierfusion.pt, attaching photographic evidence.

10.7. Once we receive your email, we will contact you to resolve the issue in a mutually agreeable manner.

10.8. Fusion will cover the return shipping costs for defective items.

11. QUALITY

Fusion does not sell second-hand products, defective products, or products of a lower quality than the market standard.

Fusion will make every effort to ensure that the colors of the products displayed on the website www.atelierfusion.pt are as accurate and true to life as possible. However, as computer monitors vary, we cannot guarantee that your monitor displays the exact colors.

12. COMPLAINTS

12.1. With the goal of continuously improving the services provided, Fusion will aim to respond to and resolve any complaints submitted by the User within five (5) business days, via email at geral@atelierfusion.pt.

12.2. In the event of a lack of conformity in the product, the User must notify Fusion as soon as the defect is de-tected, by written communication clearly and completely describing the issue. Whenever possible, supporting evidence such as photos, videos, or other media illustrating the problem should be included.

12.3. Upon receiving the complaint, Fusion will analyze the situation and, if the lack of conformity is confirmed, will offer an appropriate solution, which may include:

      a) Repair of the product;

      b) Replacement with an equivalent product;

      c) Termination of the contract and refund of the amount paid.

13. WARRANTY AND AFTER-SALES SERVICE

Fusion products are covered by the conformity warranty provided under the applicable legislation for the sale of consumer goods.

The legal warranty is valid for three (3) years from the date the product is delivered to the User, except in legally specified cases where the period may differ (e.g., refurbished goods or replaced components).

14. EXCLUSION AND LIMITATION OF LIABILITY

Fusion does not guarantee the uninterrupted operation of the website www.atelierfusion.pt or any of its features. The website may be suspended for maintenance, repairs, or updates.

Fusion shall not be held liable for any damages arising, directly or indirectly, from force majeure events that prevent it from fulfilling its obligations in any way. These may include, but are not limited to, strikes, power outages, failures in telecommunications or other services, fires, floods, inability to obtain products, materials or services, breakdowns, delays from suppliers or carriers, and changes in legislation or administrative regulations.

Fusion is not responsible for any misuse of the User's access credentials by third parties, as they are personal and non-transferable.

15. MODIFICATION OF TERMS AND CONDITIONS

Fusion reserves the right to modify these Terms and Conditions at any time. Changes will be deemed effective and Users will be notified by the publication of the updated Terms and Conditions on the website www.atelierfusion.pt.

16. PERSONAL DATA PROCESSING

We ask that you carefully read our Privacy Policy to understand the rules and procedures adopted by Fusion regarding the processing of data collected when you browse the website www.atelierfusion.pt and use its features, as well as the security and confidentiality measures in place.

17. EVIDENCE AND RECORD KEEPING

Digital records kept securely by Fusion are considered valid evidence of communications, orders, and payments made between Fusion and the User.

18. APPLICABLE LAW

These Terms and Conditions, and any disputes arising from or related to them—including their validity, use of the website, or any purchases made through it—shall be governed by Portuguese law.
